The Role of Land Survey in Land Expropriation for State or Public Needs

In Latvia the construction of new transport infrastructure objects or reconstruction of existing ones increasingly generates necessity to expand an area of land under auto roads (right of way), as well as activates necessity of efficiency of real property expropriation process. In frame of research the correlation between expropriated land and total area of affected land parcels have been analyzed in two different projects of road development – project of new road and project of road reconstruction. There is made the conclusion, that in case of reconstruction of existing road the expropriated land area is rather small, in 60% of cases it does not exceed 3% of total area of land parcel, but in case of construction of new road expropriated area of land is at least 30% of total area of land parcel. For expropriation of part of the land parcel have to be developed land survey project or detailed plan. Legislative acts define the cases when detailed plans have to be developed compulsory. However local municipality has the right to specify or define an extra area for its development. Wherewith land survey projects play more and more significant role in process of land expropriation for state or public needs.In the research was made the questionnaire of experts – land surveyors of local municipalities on actual problems of land management and real property expropriation, and was made an analysis of this questionnaire. Land survey projects for subdivision of the land as component of technical project of roads construction/ reconstruction have been developed in 42%, but development of detailed plans for identical purposes – in 30% of respondent local municipalities.
